- BASIC CONCEPTS
1.1. Personal Data Controller (hereinafter referred to as The Company): Ligita Šoliūnienė, acting in accordance with the individual activity provided for by the laws of the Republic of Lithuania (No. 779824), e-mail: info@elegantiskai.lt.
1.2. Pirkėjas (klientas) – tai asmuo, kuris e-parduotuvėje www.elegantiskai.lt lankosi kaip potencialus ar nebe pirmą kartą apsilankantis bei perkantis klientas.
1.3. e-parduotuvė – elektroninė parduotuvė www.elegantiskai.lt, kurioje šiuo metu lankotės.
1.4. Paslaugos – visos e-parduotuvės teikiamos paslaugos.
1.5. Asmens duomenys – bet kuri informacija, susijusi su fiziniu asmeniu – Duomenų subjektu, kurio tapatybė yra žinoma arba gali būti tiesiogiai ar netiesiogiai nustatyta pasinaudojant tokiais duomenimis kaip asmens kodas, vienas arba keli asmeniui būdingi fizinio, fiziologinio, psichologinio, ekonominio, kultūrinio ar socialinio pobūdžio požymiai.
1.6. Asmens duomenų tvarkymas – bet kuris su asmens duomenimis atliekamas veiksmas: rinkimas, užrašymas, kaupimas, saugojimas, klasifikavimas, grupavimas, jungimas, keitimas (papildymas ar taisymas), teikimas, paskelbimas, naudojimas, loginės ir (arba) aritmetinės operacijos, paieška, skleidimas, naikinimas ar kitoks veiksmas arba veiksmų rinkinys.
1.7. Tiekėjas – juridinis asmuo, teikiantis paslaugas e-parduotuvei, susijusias su jos vykdoma veikla, arba tiekiantis jai prekes, arba vykdantis bendrus projektus, įskaitant, bet neapsiribojant, rinkodaros akcijas, bendras pardavimų kampanijas, lojalumo programas, ir kt., žiniasklaidos priemonėse, internetiniuose puslapiuose, Elektroninėje parduotuvėje, soc. tinkluose.
1.8. Slapukas (angl. cookie) – nedidelė tekstinės informacijos dalelė, kuri automatiškai sukuriama naršant tinklapyje ir yra saugoma lankytojo kompiuteryje ar kitame įrenginyje.
1.9. Tiesioginė rinkodara – veikla, skirta paštu, telefonu arba kitokiu tiesioginiu būdu siūlyti asmenims prekes ar paslaugas ir (arba) teirautis jų nuomonės dėl siūlomų prekių ar paslaugų.
1.10. Privatumo politika – reiškia šį dokumentą, nustatantį Asmens duomenų tvarkymo principus bei taisykles, naudojantis Elektroninės parduotuvės paslaugomis.
1.11. Paskyra – pagrindiniai Kliento prisijungimo prie Elektroninės parduotuvės duomenys, kuriuos sudaro vienas elektroninio pašto adresas ir Slaptažodis.
1.12. Slaptažodis – tai Kliento sukurta unikali skaičių, raidžių, arba skaičių ir raidžių arba kitų simbolių kombinacija, kurią suvedus galima prisijungti prie Elektroninės parduotuvės. - GENERAL PROVISIONS
2.1.The Customer grants the Company the right to perform all Personal Data processing activities within the scope and for the purposes set out in this Privacy Policy.
2.2.Personal Data shall be processed in accordance with the Law on the Legal Protection of Personal Data of the Republic of Lithuania and other legal acts regulating the processing and protection of Personal Data, and this Privacy Policy. Technical and administrative solutions are also used to ensure that the personal data provided by the Customer is protected against loss or misuse.
2.3. The Company processes Personal Data in accordance with the following principles:
2.3.1. Personal Data shall be collected for defined and legitimate purposes;
2.3.2. Personal Data shall be processed accurately, fairly, responsibly and lawfully;
2.3.3. Personal Data shall be adequate and only to the extent necessary for their collection and further processing;
2.3.4. Personal data are kept up-to-date;
2.3.5. Personal data are kept in a form which permits identification of the Data Subject for no longer than is necessary for the purposes for which the data were collected and processed;
2.3.6 All information about Personal Data is confidential;
2.3.7 The Customer’s Personal Data and personal information will not be used for any unlawful purposes.
2.4 These terms and conditions apply irrespective of the type of device you use to visit our e-shop (mobile phone, tablet, computer, TV, etc.).
2.5 By making a purchase in the e-shop, the Customer is deemed to have read and accepted the Privacy Policy in its current version. If the Customer does not agree with any part of the Privacy Policy or the Privacy Policy, in such case the Customer must not place an order and not purchase the product in the Online Shop.
2.6. The Privacy Policy is available in the Online Shop and can be printed out at any time. The Privacy Policy may be amended, supplemented or updated at the discretion of the Company. The new version of the Privacy Policy shall be published in the Online Shop.
2.7. The Customer may place an order in the Online Shop without registering, or through his/her Account by registering in the Online Shop.
2.8. During the initial registration to the Online Shop through the Account, the Customer must provide his/her e-mail address and create a secure password, and must provide accurate Personal Data to the Online Shop. The Customer is responsible for their correctness. The Customer shall be provided with an identification code upon creation of the Account.
2.9. The Customer shall always provide accurate Personal Data to the Online Shop when using the Services and when making purchases in the Online Shop, and shall be responsible for the accuracy of such data.
2..10. The Customer shall have the right to change and update the Personal Data in the Account at any time, or to contact the Online Shop with a request to cancel the Account.
2.11. The Customer shall not disclose the Password to third parties and shall keep it safe, otherwise the Customer shall bear all the related liability. - COLLECTION, USE, CORRECTION AND STORAGE OF PERSONAL DATA
3.1 The Company respects the right to privacy of each Customer. The Customer’s Personal Data (i.e. name, surname, email address, telephone number, delivery address, age/year of birth, payment details (bank account number, payment method, etc.), purchase history, and, with the Customer’s consent, age, gender, date of birth, area of residence) collection and processing for the following purposes
3.1.1. for the purpose of e-commerce. The following Personal Data is processed: name, surname, email address, telephone number, delivery address, age/year of birth, IP address, payment details for goods/services. The retention period of Personal Data used for the purpose of e-commerce is 5 (five) years from the date of the last login to the Online Shop.
3.1.2. The following Personal Data is processed: name, surname, telephone number, e-mail address, address, age, gender, date of birth, place of residence. The duration of storage of Personal Data used for the purpose of Direct Marketing shall be 5 (five) years from the date of the last login to the Online Shop.
3.2 The Customer may give consent to the processing of his/her Personal Data (name, surname, telephone number, e-mail address, residential address, age, sex, date of birth) for the purpose of Direct Marketing. If, after giving consent to the processing of his/her data for the purpose of Direct Marketing, including the receipt of Direct Marketing communications, the Customer subsequently ceases to do so and informs the Company, the Company will no longer process his/her Personal Data for the purpose of Direct Marketing, and will not send the Customer any e-newsletters, except for the information related to the Customer’s order.
3.3 The Customer shall have the right at any time to withdraw its consent in clause 3.2 for the Company to process the Customer’s Personal Data for the purpose of Direct Marketing by giving notice to the Company by email to info@elegantiskai.lt and stating explicitly that it withdraws its consent to the use of the Customer’s Personal Data for the purpose of Direct Marketing and that it does not wish to receive any Direct Marketing communications.
3.4 The Customer also has the possibility to opt-out of exercising his/her right to object to the processing of the Customer’s Personal Data for the purpose of Direct Marketing by clicking on the relevant link contained in each email sent to him/her.
3.5 The Customer, as a Data Subject, has the following rights rights in relation to the procedures for processing Customer Personal Data:
3.5.1. to receive from the Company information about the processing of the Client’s Personal Data, to have access to their Personal Data and how it is processed;
3.5.2. to receive from the Company information from which sources and what Client’s Personal Data has been collected, for what purpose it is processed, to which recipients it is provided and has been provided at least in the last 1 (one) year;
3.5.3. to request rectification, destruction of the Customer’s Personal Data or to suspend, with the exception of storage, the processing of his/her Personal Data where the Personal Data is processed in a manner that is not in accordance with the provisions of the Law on Legal Protection of Personal Data of the Republic of Lithuania and other laws;
3.6 In exercising his/her rights, the Customer must present his/her passport, identity card or driving licence. The Company shall provide the Data Subject with information about the processing of the Data Subject’s Personal Data once a year free of charge. The Customer may exercise his/her rights provided for in Clause 3.5 by contacting info@elegantiskai.lt. The Company shall have the right to correct, amend, delete Personal Data or suspend the processing of Personal Data only after the identity of the Customer who made the request has been identified.
3.7. The Customer’s Personal Data shall not be disclosed to third parties, except in the following cases
3.7.1. when the Customer’s consent has been obtained, as specified in this Privacy Policy;
3.7.2. Personal Data for the purposes of electronic commerce is provided to Partners providing services to the Company in connection with the Company’s activities;
3.7.3. in the cases provided for by the laws of the Republic of Lithuania and regulations, to the competent authorities;
3.7.4. payments in the online shop are processed using the paysera.lt payment platform, therefore your personal information required for the execution and confirmation of the payment will be transmitted to Paysera LT.
3.8 The Customer is aware of his/her right to object to the processing of his/her Personal Data for the purpose of Direct Marketing, i.e. the Customer has the right to object immediately or at a later date.
3.9 The Customer consents to the transfer of his/her Personal Data to Partners for the purpose of fulfilling the Customer’s order placed on the Online Store, and for the provision of the Services to the Customer by the Company, as well as to the Company’s Partners as referred to in clause 3.7.
3.10. If the Customer does not agree to the Privacy Policy, the Customer will not be able to use the services of the Online Shop.
3.11. The Company shall implement organisational and technical measures to protect Personal Data against accidental or unlawful destruction, alteration, disclosure, as well as against any other unauthorised processing.
3.12. The Customer agrees that in cases where it is necessary pursuant to the instructions of the competent authorities and/or the Customer’s Personal Data may have been used in the course of an illegal activity, or where there are reasonable suspicions of identity theft for which a pre-trial investigation is being conducted by the competent law enforcement authorities, or where there are any other legitimate grounds or purposes, the Customer’s Personal Data shall be retained on the Company’s servers for a longer period of time than that set out in this Privacy Policy.
3.13. Upon receipt of an instruction or enquiry from a Data Subject in relation to the processing of Personal Data, the Company shall provide the Client with a response, either granting the request/instruction or reasoned refusal to do so, no later than 30 (thirty) calendar days from the date of the Data Subject’s request. If the Data Subject so requests, the response shall be in writing.
3.14. In order for the Company to be able to offer the Customer a full range of services in the Online Shop, the information Cookies are stored on the Customer’s computer (device) with the Customer’s consent and are used to identify the Customer as a previous user of the Online Shop, to collect statistics on the traffic to the Online Shop, and to collect information about the shopping cart. The Customer may at any time view which Cookies are stored and may delete some or all of the stored Cookies.

4.1 We ask for your name, telephone number, delivery address, email address and payment method details in order to fulfil your order.
4.2 We may, in order to further develop and improve the website, conduct surveys and otherwise ask you to provide us with information about the use of our e-shop.
4.3 The data you provide will enable us and our processors to fulfil your order and provide you with our services.

4.5. By using this e-shop, you agree that:
4.5.1. you will be contacted by email or by telephone to discuss your order or to answer any question you may have;
4.5.2. the necessary information will be passed on to the parcel service in the event that you need to be contacted about the delivery of your order.
4.6. We take particular care in processing your data and ensure that any information you provide is treated with due discretion and in accordance with the Law on the Legal Protection of Personal Data. Therefore, we will neither sell your personal data to third parties nor use it for purposes that are unrelated to the relationship between the company and the client.
4.7. The information you have provided to us will be used for the following purposes:
4.7.1. to dispatch your order;
4.7.2. to provide the parcel service with details of the delivery location and your details so that it can contact you, if necessary, to check that it is you who has placed the order; and to acknowledge receipt or to resolve any problems that arise;
4.7.3. to correspond by email in the future about possible offers that might be useful to you (subject to your prior consent).
4.8. Any information you provide is only used for the purpose of confirming your identity and to enable us to deliver your order promptly.
4.9 It is one of our policies to ensure your personal security when you use our services. We therefore make every effort to ensure that our operations are processed securely and that the personal data you provide us with is kept secure. All information we process is encrypted and transmitted over secure internet communication channels.
4.10. Please be advised that in order to encrypt the personal data and other classified information that you send us, we use the standard cryptographic protocol SSL ( secure sockets layer) for encrypting the transmission of data over the internet. 4.12. It is also very important that you do not disclose your passwords to anyone. Remember that anyone who knows or can see your password will be able to log into your account at any time as if they were the primary user. Therefore, it is a good idea to create a different password for each online account.

We also recommend that you do not use common dictionary words or easily guessable terms such as your name, address, date of birth or other personal details that could be easily identified.
