Purchase terms and conditions

  1. General Provisions
    1.1 These Terms and Conditions of www.elegantiskai.lt (hereinafter referred to as the “Terms and Conditions”) constitute a legally binding document for the Buyer and the Seller (hereinafter referred to as the “Seller”), which sets out the rights, duties and responsibilities of the Parties.
    1.2 The Seller reserves the right to change, modify, amend or supplement these Terms and Conditions at any time. The Buyer shall be informed of changes to the Terms and Conditions on the website of the e-shop.
  2. Parties and their contact details
    2.1. SellerLigita Šoliūnienė, working in accordance with the individual activity provided for by the laws of the Republic of Lithuania (No. 779824), e-mail: info@elegantiskai.lt.
    2.2. Buyer (the customer) means a person who visits the website as a potential or first-time customer and who is at least 18 years old.
  3. Conclusion of the Purchase and Sale Agreement
    3.1 The Purchase and Sale Agreement between the Buyer and the Seller shall be deemed to have been concluded when the Buyer forms and submits an order for the Goods in the electronic shop www.elegantiskai.lt, having first read these Terms and Conditions, and makes the payment.
  4. Seller’s rights
    4.1 In the event of serious circumstances, the Seller may temporarily or completely suspend the operation of the online shop without prior notice to the Buyer.
    4.2 If the Buyer attempts to undermine the operation, stability and security of the online shop or breaches his/her obligations, the Seller shall have the right to limit or suspend his/her access to the online shop without prior warning.
  5. Obligations of the Seller
    5.1 The Seller undertakes to make available the services of the e-shop, the conditions of operation of which are set out in these Terms and Conditions.
    5.2 The Seller undertakes to protect all personal data transmitted by the Customer.
    The Seller undertakes to deliver the goods purchased by the Buyer by the delivery method chosen by the Buyer, in accordance with the terms and conditions set out in these Terms and Conditions of Sale and Purchase.
    5.4. Where, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the online store, the Seller shall have the right to terminate the Sale and Purchase Contract by notifying the Buyer in advance. The Seller may offer a similar product. If the Buyer refuses, the Seller undertakes to refund the money paid within 3 working days.
    5.5. If the Buyer exercises the right provided for in Clause 6.2 of the Terms and Conditions, the Seller undertakes to refund the Buyer within 14 (fourteen) days from the date of receipt of the goods to be returned.

  6. Buyer’s rights
    6.1 The Buyer shall have the right to purchase goods in the online shop in accordance with these Terms and Conditions.
    6.2 The Buyer shall have the right to withdraw from the contract of sale of goods concluded in the online shop by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.
    6.3. The Buyer may exercise the Buyer’s right referred to in clause 6.2 only if the goods have not been used, damaged or substantially altered in appearance, are labelled and in their original packaging.
    6.4. The Buyer agrees to transfer his/her personal data necessary for the fulfilment of the order.
  7. Buyer’s Obligations
    7.1 The Buyer shall pay for and accept the goods purchased in accordance with the procedures set out in these Terms and Conditions.
    7.2 If the Buyer refuses to accept the goods at the time of delivery without good reason, the Buyer shall be obliged to bear the cost of returning the goods at the request of the Seller.
    .3 Upon delivery of the Goods to the Buyer, the Buyer shall check the condition of the consignment and the Goods(s) together with the person delivering the consignment.
    7.4. By using the Online Shop, the Buyer confirms that he/she agrees to and is obliged to abide by these Terms and Conditions of Sale and Purchase.
  8. Prices of Goods
    8.1 The prices of goods in the online shop are quoted in euros. Prices are inclusive of VAT. Delivery charges are added to the total amount of the goods after the order has been confirmed.
    8.2. Some goods vary in price depending on the size, so that you need to check the price of the item again once you have chosen your size.
  9. Ordering and payment
    9.1 The Buyer, after visiting the e-shop, selects the goods he/she likes and puts them in his/her shopping cart. After the shopping cart has been created, the Buyer shall enter the personal data necessary for the execution of the order: his/her name, surname, address to which the goods will be delivered, telephone number, e-mail address and any additional information that may be relevant for the delivery of the ordered goods. The Buyer acknowledges that he/she has read these Rules and confirms the order. The order will only be processed upon receipt of payment for the item(s).
    9.2. The characteristics of all goods sold shall be set out in the description of each item. The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the online shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer.     9.3. If the Buyer has not paid the amounts due, the order shall be deemed to have been cancelled.
    9.4. Payment can be made using Swedbank, Seb, Luminor, Citadele and Šiaulių bankas e-banking services. Payments can be made in Euro currency. Payments are processed using the MakeCommerce.lt payment platform.
  10. Delivery
    10.1 The Buyer must specify the exact delivery address when ordering the Goods.
    10.2 The Buyer must take delivery of the Goods himself. If the Buyer is unable to take delivery of the goods himself, but the goods are delivered to the address specified by the Buyer, the Buyer shall not be entitled to make any claim in respect of the delivery of the goods to the wrong person.
    10.3. The Seller shall deliver the goods to the Buyer in accordance with the terms specified in the descriptions of the goods, but not later than 30 days from the day of conclusion of the contract.
    10..4. in the event of the Buyer’s withdrawal from the contract of sale of the goods, the Buyer shall be refunded all sums paid by the Buyer, including the costs of delivery of the goods paid by the Buyer.
    10.5. the goods shall be delivered in the territory of Lithuania and in foreign countries.
    10.6. the e-shop www.elegantiskai.lt operates on the dropshippingbasis, whereby it is operated by a number of different suppliers. Therefore, goods placed in the basket from different suppliers may be delivered to the Buyer in separate shipments and on different dates (the exact date is indicated next to the specific product).
    10.7. If the Buyer provides incorrect information or an inaccurate address, the Buyer undertakes to reimburse the Seller for all costs associated with delivery.
  11. Returns
    11.1 Goods of good quality may be returned within 14 days of receipt. The defects of the goods sold in poor quality shall be eliminated, the poor quality goods shall be replaced and the goods shall be returned in accordance with the provisions of the Civil Code of the Republic of Lithuania 6.3641.
    The Buyer shall receive a return form together with the goods, which contains information and conditions for the return.
    11.2. The returned goods must be in the original packaging, in the same condition as when you received the goods (this point does not apply in the case of returns of low-quality goods);
    11.2.2.2.The goods must be in the same condition as when you received them: undamaged, unused, unworn, with no loss of merchandise appearance: no damaged labels, no torn protective films, etc.
    (The returned goods must be in the same condition as received by the Buyer (this clause does not apply in the case of returns of low quality goods);
    11.2.3.2.4 The Seller shall have the right to refuse to accept the Buyer’s returned goods if the conditions for the return of goods have not been complied with;
    11.2.5. The return of goods shall be carried out in the manner prescribed by the Seller within 14 (fourteen) days from the date of receipt of the goods (this clause does not apply in the case of low-quality goods, in which case return of the goods shall be carried out within the statutory warranty period).
    11.3. The return and exchange of goods of suitable quality shall be carried out in accordance with Article 6.22810, Paragraph 1 of the Civil Code.
    11.4 Money paid for goods accepted by the Buyer but subsequently rejected shall be refunded to the Buyer’s account no later than 14 (fourteen) days from the date of the return of the goods to the Seller, unless the Seller and the Buyer agree otherwise.
    11.5 Goods made or sewn to the Buyer’s individual order (with the addition of special features or attributes tailored to the Buyer’s personal needs; for goods not included in the public offer; for goods made according to the Buyer’s specifications (e.g. adjusted standard size, selection of fabrics atypical of the Seller’s range, etc.)) shall not be returned and shall not be exchangeable.
    11.6. The Seller shall pay the delivery costs for the return of the goods.
  12. Restrictions and Prohibitions
    12.1 Under no circumstances may this online shop be abused. By using it, you agree that:
    12.1.1. you will not: 12.1.1. cause or incite the commission of any criminal offence;
    12.1.2. provide or distribute any harmful or malicious content or viruses;
    12.1.3. You will not disrupt the integrity of this website by any action, including intrusions into the database, distortion of data, interfering with other users’ use of this online shop, disrespecting the privacy or rights of other users, sending unsolicited advertising or marketing material, or attempting to modify the programs of any network or computer service connected to this e-shop;
    12.1.4. you will not copy, republish or use any of the content, images, photographs, text on this website without the prior written permission of the owner of this website, and you will comply with all copyright laws.
    12.2 We cannot be liable for any loss or damage caused by the attack of viruses or other technological constructs that are genuinely harmful to your computer, including specific programs, data, or other material contained therein, while you are voluntarily downloading material from this or any other website linked to it.
    12.3 We reserve all rights to render any user account inoperable at any time if we suspect that a malicious attack may have occurred, or if we believe that a user has violated these Terms of Sale and Purchase, including by direct violation and misuse.
    12.4 If, when you open this website, you find that the presentation does not meet your needs, or if you see pages or links that do not take you where you expected, please let us know about such inconvenience so that we can make any necessary corrections. Of course, we recommend that you update your browser so that the latest version is installed on your computer. Please also make sure that JavaScript support is enabled in your browser.
  13. Final Provisions
    13.1 These Terms and Conditions are made in accordance with the laws of the Republic of Lithuania.
    13.2 These Terms and Conditions and the relationship between the Parties hereto shall be governed by and interpreted in accordance with the laws of the Republic of Lithuania.
    13.3 All disagreements arising from the performance of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
    13.4. The Parties shall be excused from the performance of their obligations under these Terms and Conditions if they cannot be fulfilled due to unforeseeable circumstances beyond the Parties’ control(force majeure).
